By way of quick introduction, my name is Melissa Bush.  As a practising solicitor, I’ve assisted businesses for over 27 years, and what I’ve consistently seen is business owners coming to me to sort out a legal issue, which when I look into it, could have been avoided in the first place.  If only the business owner had some core knowledge and understanding of what their legal responsibilities were – then they could have put some structure and documentation in place to avoid the issue arising.

Some examples of this are:

• The client who went into business with his brother, no agreements were drawn up, and the brother essentially ran off with the business.
• The client who gave his friend some cash jobs to do. The friend caused thousands of dollars worth of damage to a customer’s property, but the big question was – was he an employee or a contractor?
• The client who opened a new business, registered a business name, then was approached by another business owner who had a registered trade mark over a similar business name.

In these instances, these issues could potentially have been avoided by a shareholders agreement, an employment agreement, doing proper searches before deciding on the business name. 

Instead, the business owners ended up with no business, thousands paid to the customer for the damage, and having to totally rebrand the business.

A big part of my day to day practice is educating business owners on the core essential laws of business.  Knowledge is power.  And if they have this core knowledge, then they can take steps from the start to save wasting time, money and energy down the track.

So this is what has driven me to create this new offering.
